Welcome to Aeternus. By creating an account or using our service, you agree to these Terms of Service. Please read them carefully.

1. Your Account

You are responsible for maintaining the security of your account and password. Aeternus cannot be liable for any loss or damage from your failure to comply with this security obligation.

2. Your Content

You retain ownership of all memories, videos, writings, and other content you create or upload. You grant Aeternus a limited license to store, display, and deliver that content back to you and to the recipients you designate, solely to operate the service.

3. Acceptable Use

You agree not to use Aeternus to store unlawful content, to infringe the rights of others, or to misuse the service in any way that could harm another person or the platform itself.

4. AI Voice Cloning & Visual Avatar

Aeternus offers AI-powered features that create a digital voice clone from your voice recordings and a visual avatar from your photograph. By using these features, you acknowledge and agree that:

• You are providing your own voice recordings and your own photograph, and you have the right to do so.
• Your voice clone and visual avatar are used solely within Aeternus to generate responses in your voice and likeness, so that your loved ones can interact with your memories after you are gone.
• You consent to the processing of your voice and facial data by our third-party AI providers (ElevenLabs for voice synthesis and D-ID for visual avatar generation) for the sole purpose of creating and delivering these features.
• You may delete your voice clone or visual avatar at any time by removing the associated recordings or photo from your profile.
• You understand that AI-generated content may not perfectly replicate your voice or appearance, and Aeternus is not liable for the accuracy or realism of generated responses.

5. Biometric Data

Voice recordings and facial photographs are biometric data. We process this data only with your explicit consent to create the AI features described above. We do not use your biometric data for any other purpose, and we do not sell it to third parties. You may withdraw consent and request deletion of your biometric data at any time by deleting the associated content from your account.

6. Subscriptions & Payments

Paid plans are billed through our payment provider. You may cancel at any time. Refunds are handled in accordance with the terms presented at checkout.

7. Service Availability

We work to keep Aeternus available and reliable, but we do not guarantee uninterrupted access. Features may change over time as we continue to improve the service.

8. Limitation of Liability

Aeternus is provided "as is." To the fullest extent permitted by law, we are not liable for indirect, incidental, or consequential damages arising from your use of the service.
